政策解读/ Policy Analyzing一、元旦：2022年1月1日至3日放假，共3天【无调休,其中1月1号为法定休息日】New Years Day: Holiday from January 1st to 3rd, 2022, a total of 3 days.【No time off in lieu，January 1 is statutory holiday.】。

二、春节：1月31日至2月6日放假调休，共7天【1月29日（星期六）、1月30日（星期日）上班，其中2月1号至3号为法定休息日】Spring Festival: Holidays will be adjusted from January 31 to February 6 , a total of 7 days. 【Work on January 29 (Saturday) and January 30 (Sunday) ，February 1 to 3  are statutory holidays.】。

三、清明节：4月3日至5日放假调休，共3天【4月2日（星期六）上班，其中4月5号为法定休息日】Tomb-Sweeping Day: Holidays will be adjusted from April 3 to 5, a total of 3 days.【Work on April 2 (Saturday)，April 5 is statutory holiday.】。

四、劳动节：4月30日至5月4日放假调休，共5天【4月24日（星期日）、5月7日（星期六）上班，其中5月1号为法定休息日】Labor Day: Holidays will be adjusted from April 30 to May 4, a total of 5 days. 【Work on April 24 (Sunday) and May 7 (Saturday)，May 1 is statutory holiday.】。

五、端午节：6月3日至5日放假，共3天【无调休，其中6月3号为法定休息日】Dragon Boat Festival: Holidays will be adjusted from June 3 to 5, a total of 3 days. 【No time off in lieu，June 3  is statutory holiday.】。

六、中秋节：9月10日至12日放假调休，共3天【无调休，其中9月10号为法定休息日】Mid-Autumn Festival: Holidays will be adjusted from September 10 to 12 a total of 3 days. 【No time off in lieu, September 10 is statutory holiday.】。

七、国庆节：10月1日至7日放假调休，共7天【10月8日（星期六）、10月9日（星期日）上班，其中10月1号至3号为法定休息日】National Day: Holidays will be adjusted from October 1 to 7, a total of 7 days. 【Work on October 8(Saturday) and October 9 (Sunday)，October 1 to 3 are statutory holidays.】。

知识点补充/Supplementary Knowledge问：法定节假日（上述标注11天）加班工资支付标准？Q: Statutory holidays (11 days marked above) overtime payment standard"？

答：根据《劳动法》第四十四条的规定，法定节假日安排劳动者工作的，支付不低于工资的300%的工资报酬法定节假日（上述标注11天）不可调休因为法定节假日具有不可替代性，所以也不可能通过安排调休的方式来使劳动者享受到法定节假日的相关权利。

A: According to the provisions of Article 44 of the Labor Law, workers who are arranged to work on statutory holidays shall be paid not less than 300% of their salary. Statutory holidays (11 days marked above) are not adjustable. Because statutory holidays are irreplaceable, it is impossible to arrange time off to enable workers to enjoy the rights of statutory holidays. 

问：周六周日上班工资如何计算，是否可以安排调休？Q: How is the salary calculated for work on Saturdays and Sundays, is there could be arranged time off?

答：《工资支付暂行规定》第十三条规定：用人单位依法安排劳动者在休息日工作，而又不能安排补休的，按照不低于劳动合同规定的劳动者本人日或小时工资标准的200%支付劳动者工资，可以安排其在正常工作日内调休Answer: Article 13 of the "Interim Regulations on Salarye Payment" stipulates that if the employer arranges the employee to work on the rest day according to the law, but cannot arrange compensatory rest, the wage shall not be lower than the employees daily or hourly salary as stipulated in the labor contract. 200% of workers’ salary are paid, and they can be arranged to take a rest during normal working days.
